This is an action of contract on an account annexed to recover compensation for “board, room, lodging, care and nursing” furnished by the plaintiff to the defendant’s testatrix, who will be hereinafter described as the decedent. The defendant’s answer contained a general denial and a plea of payment. The case was tried to a jury and at the close of the evidence the defendant filed a motion for a directed verdict, which was denied subject to his exception.
