McKEE, Circuit Judge.

Carl M. Smith, an inmate at the Pennsylvania State Correctional Facility at Frackville (“SCI-Frackville”) filed this civil rights action under 42 U.S.C. § 1983 alleging that certain corrections officers and prison employees denied him due process of law and/or violated his Eighth Amendment right to be free from cruel and unusual punishment. The district court dismissed Smith’s due process claims against some of the defendants under Fed. R.CivP. 12(b)(6), but Smith was allowed to proceed on his Eighth Amendment claims.
