Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered June 22, 2001, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree (two counts).

Following a jury trial, defendant was convicted of two counts of criminal sale of a controlled substance in the third degree for selling crack cocaine twice in one hour on August 3, 2000 out of an apartment in the Village of Ellenville, Ulster County, to a *742State Police investigator working undercover with the Community Narcotics Enforcement Team.
