Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered June 22, 2001 upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree (two counts).

Following a jury trial, defendant was convicted as charged of two counts of criminal sale of a controlled substance in the third degree for two sales of cocaine to an undercover State Police Investigator, which took place in the Village of Ellenville, Ulster County in August 2000.
