This action, brought to recover damages for injuries inflicted by defendant to plaintiff’s underground telephone cable, was tried without a jury, by the circuit court of Winnebago county, resulting in a judgment for the defendant, and the plaintiff appeals.

The evidence disclosed that the plaintiff is a public utility engaged in the telephone business in Eockford, Illinois. On August 16, 1948, the Rockford City Council issued to it an ordinance permit granting to the plaintiff the right to place buried cable in the parkway along Eural Street in the City of Rockford.
