This action was brought by plaintiff, NL Industries, Inc. (“NL” or “plaintiff’) to recover cleanup costs associated with contamination resulting from the construction of a seawall and jetty in the Laurence Harbor area of Old Bridge Township, New Jersey (“the Township”), known as the Raritan Bay Slag Site (“RBS site”).
