The material facts giving rise to this litigation are as follows: Plaintiff, Clifford, was the owner of the 44 brand of cattle and horses, ranging partly in Mexico and partly in Santa Cruz county, Arizona, and the defendant, Sorrells, owned the OXO brand of cattle, ranging in Santa Cruz county. On September 19, 1919, at Nogales, in pursuance to an agreement made September 12th, they traded brands by each executing to the other a bill of sale of his brand, making no mention therein of the number or kind of cattle in either brand.
