Tlie plaintiff, tlie Portsmouth Clay Products Company, instituted this action in the Court of Common Pleas of Scioto county to recover from the defendant, The National Bank of Portsmouth, for losses sustained by reason of the vice-president, secretary, general manager and director of plaintiff company, without any authority so to do, depositing to his personal account in defendant bank certain checks made payable to the order of plaintiff.
