OPINION

SHEA, Justice.

This matter comes before the Supreme Court on the plaintiff’s appeal and the third-party defendant’s cross-appeal from a judgment in favor of the plaintiff entered by the Superior Court. We affirm.

Moseman Construction Co. (Moseman) commenced this declaratory judgment action in the Superior Court against the State of Rhode Island Department of Transportation (DOT) and the Rhode Island Port Authority and Economic Development Corporation (Port Authority) (collectively, the state).
