Swift & Company sued tbe Dawson Paper Shell Pecan Company on a promissory note signed “Lowery Brothers Company, per M. M. Lowery, Secretary and Treasurer,” alleging that the Dawson Paper Shell Pecan Company was a corporation and had absorbed Lowery Brothers Company, which was also a corporation, and had assumed the indebtedness of Lowery Brothers Company. At the conclusion of the evidence submitted in behalf of the plaintiff, the court, upon motion of defendant’s counsel, granted a nonsuit. To this ruling the plaintiff excepted.
