On September 12, 1966 relator (defendant) was sentenced to a term of one year in thé Erie County Penitentiary after being found guilty by a jury, at an Extraordinary Special and Trial Term of the Supreme Court, of the crime of conspiracy in violation of subdivisions 1, 4 and 6 of section 580 of the Penal Law. He filed a notice of appeal on the day of sentence, secured a certificate of reasonable doubt and was released on bail pending the determination of his appeal.
