LASKER, District Judge.
Aurelia Garcia brought this action pursuant to 42 U.S.C. §§ 405(g) and 1383(c)(3) (1982) to review a final determination of the Secretary of Health and Human Services (the “Secretary”) denying her application for Social Security disability benefits. Garcia moves and the Secretary cross-moves for judgment on the pleadings pursuant to Rule 12(c) of the Federal Rules of Civil Procedure. For the reasons stated below, Garcia’s motion is granted insofar as it seeks a remand to the Secretary for *492reconsideration upon the existing record. The Secretary’s cross-motion is denied.
