MEMORANDUM AND ORDER GRANTING SUMMARY JUDGMENT ON COUNTS II, III AND V
GARRITY, District Judge.
Plaintiffs filed this action on October 14, 1980 alleging violations of state and federal securities laws and common law fraud on the part of the defendant corporation. The defendant moved on March 17, 1982 for summary judgment on all five counts of the complaint. Oral argument on the motion was heard on September 29, 1982.
