Appeal from a judgment of the County Court of Chemung County (Danaher, Jr., J.), rendered June 29, 1989, upon a verdict convicting defendant of the crime of criminal possession of a forged instrument in the second degree.

Defendant was convicted of possessing, with the intent to defraud another, a forged Social Security disability check payable to Robert Butler in the amount of $571. The check had been taken from Butler’s mailbox and subsequently cashed in a supermarket.
