STAKELY, Justice.
W. B. Mims, James E. Putnam and John W. Barbee (appellants) are members of the Board of Commissioners of Phenix City, and Morris J. West (appellant) is the Chief of Police of that city. Douglas M. Blanton (appellee) has been employed as a policeman by the city and by virtue of the Civil Service Act pertaining to the city (Local Acts 1947, No. 15, p. 14), was under civil service status.
