This action was brought by the plaintiff, a citizen of the State of New York, as trustee ad litem on behalf of himself, as father, and of Edith Palmer, as mother, of Kenneth Palmer, deceased, to recover damages for the death of Kenneth Palmer under the Act of 1855, P.L. 309, 12 P.S. § 1602, as amended, and the Pennsylvania Rules of Civil Procedure, No. 2202(b), 12 P.S.Appendix.
