Appeal from Guthrie Circuit Court. Action in equity to obtain tbe cancellation of a judgment and a new trial. Tbe plaintiff avers tbat tbe rendition of the judgment was without jurisdiction, and was obtained by fraud. There was a decree for tbe defendant. The plaintiff appeals.
