Appeal from an order of the Supreme Court, Erie County (Russell E Buscaglia, A.J.), dated August 14, 2013. The order, among other things, granted the motion of defendant to suppress his statement and certain physical evidence.
It is hereby ordered that the order so appealed from is unanimously affirmed and the indictment is dismissed.
