STEPHENS, Associate Justice.
The judgment appealed from established the western boundary of the James Hamilton survey No. 92 to be 38 varas east of where appellant claimed it, and 38 varas east of where the calls for distance in the field notes of that survey placed it,— appellee, who was the owner of the E. D. Whitney, a junior survey calling for the Hamilton, recovering the strip of land in dispute from appellant.
