MORGAN, J.,

Dissenting. — This action was commenced in this court for the purpose of procuring a judgment, recommending to the legislature that plaintiff’s claim against the state, for money alleged to have been earned by him in the performance of services as attorney for the Idaho Liquor Board, be paid. The action is authorized by Idaho Constitution, article Y, section 10, which provides:
