MEMORANDUM AND ORDER

GARZA, District Judge.

Plaintiff, Gregorio Garcia, brought this suit seeking to have this Court declare invalid and enjoin the enforcement of Article 6840, Vernon’s Texas Revised Civil Statutes Annotated, and the implementation of this article through Rules 696-716, Texas Rules of Civil Procedure. Article 6840 and Rules 696-716 contain the provisions which allow the issue of a writ of sequestration for the return of personal property.
