Mason, J.:
Each house of the legislature of 1903 was understood to have voted in favor of a resolution for the submission to a popular vote, at the general election in 1904, of a proposal to amend the con-: stitution so as in effect to allow the state, in some circumstances, to obtain a change of venue in criminal cases. The attorney-general believed that the legislative records did not show that precisely the same resolution had been adopted by both bodies, and therefore gave his opinion that the proposition ought not to be submitted to the people.
