ORDER DENYING DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT
WOLLENBERG, District Judge.
This action was filed on February 9, 1973, under § 11 of the Equal Op portunity Employment Act of 1972, 86 Stat. 103, 42 U.S.C. § 2000e — 16, which requires that “All personnel actions affecting employees or applicants for employment ... in executive agencies ... as defined in section 105 of title 5 . shall be made free from any discrimination based on race, color, religion, sex, or national origin.” 1 42 U.S.C. § 2000e — 16(a).
