Appeal from circuit court, New York county. Action by the Electric Power Company against the Metropolitan Telephone & Telegraph Company for conversion. From a judgment entered on a verdict in favor of plaintiff, and from an order denying a motion for a new trial, defendant appeals. Affirmed.

In his charge to the jury the learned trial judge clearly stated the facts and defined the issues. As therein said:
“On or before April, 1891, it appears from the proofs that the plaintiff corporation was engaged in the maintenance of lines of electric wires, over which it furnished power to customers for the movement of machinery, for which the plaintiff charged and received certain rentals or compensation.
