MEMORANDUM AND ORDER

ALLEN SHARP, District Judge.

The plaintiff, Robert M. Grooms, filed an action under the Civil Rights Act, 42 U.S.C. § 1983 m this Court on July 23, 1976. The defendants were all members of the Elk-hart County Sheriff’s Department or the Indiana State Police. The plaintiff alleged that his arrest on December 2, 1974 and subsequent detention, denied him due process of law as provided by the Constitution.
