—Judgment, Supreme Court, New York County (Rose L. Rubin, J.), rendered July 11, 1991 which convicted defendant, after a jury trial, of robbery in the second degree and petit larceny, and sentenced him to concurrent terms of 3 Vs to 10 years and 1 year, respectively, unanimously affirmed.

The court did not denigrate the defense when it questioned defendant about his production of an unmarked piece of evidence produced during defendant’s in-court demonstration of a swindle he practiced upon the victim.
