Appellant was convicted of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of fifteen years; and prosecutes this appeal.

The theory of the State was that appellant and Lewis Jenkins entered into a conspiracy to kill deceased Arthur Gray, and that they prepared themselves on the night of the homicide and lay in wait for deceased. Deceased approached on foot where they had located themselves in the fence corner on his way to Wash Jenkins', who lived nearby, and his son Shelly Gray accompanied him on horseback, and as they approached where…
