CHRISTIAN, Judge.

— The offense is murder; the punishment, confinement in the penitentiary for life.

This is the second appeal of this case. Perkins v. State, 117 Texas Crim. Rep., 415, 37 S. W. (2d) 163.

Deceased, W. C. White, was an officer of the police force of the city of Orange, his hours of service being from 5 o’clock p. m. until 5 o’clock a. m. On the night of the homicide Leonard Carr, a service car driver, and deceased met at a cafe shortly after midnight. Deceased entered Carr’s automobile and the parties drove about the city of Orange.
