HARRIS, Judge.
These two cases are so intertwined we feel they should be consolidated and disposed of at one and the same time. These two records were submitted on briefs on July 17, 1973.
On July 25, 1972, appellant was indicted by the Grand Jury of Baldwin County for possession of marihuana in violation of the Uniform Controlled Substances Act. On August 14, 1972, he appeared in open court with his attorney and pleaded guilty to the indictment and was sentenced to three (3) years imprisonment in the penitentiary.
