Ppiaintiff, E. W. Pa)triclcv in his lifetime, sued to recover damages resulting from alleged negligence on the part of defendant in performing a surgical operation. At the close of the case the court directed a verdict for defendant on the ground that plaintiff’s cause of action was barred by the Statute of Limitation. Judgment was entered in accordance with the directed verdict, and after the usual motion plaintiff appealed.
