MEMORANDUM OPINION

SIMPSON, District Judge.

The plaintiff, Jon W. Ackerson (hereinafter “Ackerson”), is a candidate for election to the office of Judge of the Kentucky Court of Appeals. He has brought this action against the Kentucky Judicial Retirement and Removal Commission (hereinafter “Commission”) pursuant to 42 U.S.C. § 1983, alleging that his freedom of speech, guaranteed by the First, Fifth and Fourteenth Amendments to the United States Constitution, is compromised and chilled by virtue of a canon of the Kentucky Code of Judicial Conduct which regulates campaign conduct of candidates…
