This suit was brought upon a fidelity bond issued to the Nashville Protestant Hospital by the Aetna Casualty & Surety Company insuring it against loss by any act or acts of fraud, dishonesty, theft, or embezzlement on the part of certain employees, directly or through connivance with others.

It was alleged in the original bill that the hospital had sustained a loss of $2,754.74 on account of embezzlement of its funds by its bookkeeper, Edna B. Nellums, one of the employees covered by the bond; that notice of the discovery of the loss had been given the bonding company and claim filed, but the…
