On January 23, 1987, this court heard defendant’s (“Kennecott”) motion for summary judgment with regard to plaintiff’s claim for punitive damages, and third party defendant’s (“Stockmar”) motion for summary judgment on the third-party complaint and Kennecott’s cross motion for partial summary judgment on the third-party complaint.
