Appeal by the defendant, Burt L. Hill, from a judgment of the Municipal Court of the city of Buffalo in favor of the plaintiff, entered in the office of the clerk of said court on the 12th day of June, 1902, upon the decision of the court adjudging the defendant guilty of violating the ordinances of the city of Buffalo in selling meats without a license outside the public markets.

Spring, J.:

This action was commenced in the Municipal Court of the city of Buffalo to recover a penalty of the defendant for selling meats without having procured a license or permit therefor as required by the ordinances of said city. The charter of the city (Laws of 1891,' chap. 105) requires the common council to enact ordinance» (§ 17, subds. 6) 8) “ to license and regulate plumbers, auctioneers, butchers, hawkers, peddlers,” etc., and to “ regulate * * * the halé of meats, fish and vegetables.” The common council of the city established four markets located in different parts of the city…
