BRIEANT, District Judge.

By motion filed February 29, 2000, heard and fully submitted on April 7, 2000, Defendants, in this action pursuant to 42 U.S.C. § 1983 for violation of civil rights, move pursuant to Rule 12(b)(6) Fed. R.Civ.P. to dismiss the complaint for failure to state a claim or in the alternative to dismiss the complaint against defendants George P. Bucci, Jr., Nancy W. LaColla, 1 Robert J.
