Appeal by the plaintiff from an interlocutory judgment of the City Court of the city of New York overruling demurrers to three separate defences alleged in the answer.

This appeal presents for determination the sufficiency of the first, third and fourth defences alleged in the answer. The complaint alleges a cause of action based upon a written agreement between the plaintiff and the defendant, and the action is brought to recover payments alleged to be due under such agreement. The agreement is attached to and made a part of the complaint.

The defendant and the plaintiff were husband and wife - and entered into the separation agreement on January 12, 3911. The complaint alleges that under the terms of the agreement the defendant agreed, among other things,…
