This appeal arises out of a pending divorce proceeding in which the superior court ordered Derrick Diggs to make monthly payments of $403 on a mortgage and $400 for the support of his wife and child pendente lite. Diggs failed to make these payments and thereafter was ordered to show cause why he should not be found in contempt. After a jury trial, which was prosecuted by Vera Diggs’ attorney, the jury found that “Mr. Diggs has wilfully failed to comply with the orders of the court for the support of his child and spouse.” The superior court ordered Derrick Diggs to serve ninety days…
