ROBINSON, J.

The petitioner, Luis Fernandez, following a grant of certification to appeal by the habeas court, appeals from the judgment of the habeas court dismissing his petition for a writ of habeas corpus. The petitioner claims on appeal that the habeas court *175improperly dismissed his petition for a writ of habeas corpus for lack of subject matter jurisdiction because the petitioner was not in custody pursuant to General Statutes § 52-466.1 We disagree and affirm the judgment of the habeas court.
