This appeal involves a dispute between TracFone Wireless, Inc. (“TracFone”)— which provides prepaid wireless phone service primarily through third-party retailers — and the Commercial Mobile Radio Service Emergency Telecommunications Board (“CMRS Board” or “the Board”)— an entity created by the Kentucky General Assembly to develop an emergency 911 system for wireless customers in Kentucky.
