Pending before this Court is the Motion to Dismiss of the Defendants Robin and David Euler, filed pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure, on the basis of lack of subject matter jurisdiction, and pursuant to Rule

12(b)(6), for failure to state a claim upon which relief may be granted. Also pending is Plaintiff Mays & Associates’ Motion for Preliminary Injunction and Motion to Amend its Complaint.
