OPINION
SINGLETON, Judge.
Sidney R. Hertz was indicted for murder in the first degree. AS 11.41.100. Hertz *407was convicted, following a jury trial, of the lesser-included offense of murder in the second degree. AS 11.41.110. Superior Court Judge J. Justin Ripley sentenced Hertz to forty years’ imprisonment with no eligibility for parole until he had served twenty years. Hertz appealed, challenging his conviction and sentence. We affirmed. Hertz v. State, Memorandum Opinion and Judgment No. 1225 (Alaska App., September 10, 1986).
