Commonwealth v. One Thousand Four Hundred Dollars ($1,400) in United States Currency

Joseph DiJoseph (DiJoseph) appeals a decision of the Court of Common Pleas of Chester County (trial court) denying his request for a jury trial in a forfeiture action commenced by the Commonwealth of Pennsylvania (Commonwealth) under the Controlled Substances Forfeiture Act.1

On January 11,1994, DiJoseph was arrested and charged with the crimes of possession 2 and possession with intent to deliver3 five pounds of marijuana that he allegedly had purchased from a police informant. At the time of DiJoseph’s arrest, the police seized his vehicle and $1,400.00 in cash.
