COCHRAN, District Judge.

This cause is before me for final judgment. It is a suit on a note for $50,000 executed, on behalf of the defendant, by its county judge, to which the seal of the county was affixed and attested by its county clerk, August 17, 1921, due December 17, 1921, and bearing 6 per cent, interest, in consideration of that sum of money that day loaned by the plaintiff to the defendant. It was executed pursuant to a resolution of the fiscal court of the defendant that day passed, which recited that the note was given in “anticipation of the taxes for 1921 for county purposes,”…
