— On September 14, 1965, appellee filed a petition to transfer this cause to the Supreme Court, asserting therein that appellee in its petition for Writ of Certiorari properly raised the constitutional question of the unlawful taking of its property without just compensation in violation of the constitution ; and, also in violation of the due process clause thereby challenging the constitutionality of the zoning ordinance as to its property.
