MEMORANDUM

MOTZ, District Judge.

This action (pending since August 1982) arises from the failure of a piece of heavy industrial equipment known as an Angelo Rotary Furnace System to perform its intended function of converting wood waste products into char for the purpose of making commercial charcoal. Plaintiff is Wood Products, Inc., the purchaser of the furnace. The defendants are CMI Corporation, the manufacturer of the furnace, and James F.
