Savoy Construction Company, Inc. (Savoy), initiated this tort action against Virginia Electric and Power Company (Vepco), for property damage. Savoy’s motion for judgment alleged that the Arlington County Pollution Control Plant, which was being constructed by Savoy as general contractor, was damaged in an explosion and fire resulting from Vepco’s negligence. Savoy sought to recover damages for repairs it had been required to make under its contract with Arlington County. Denying liability, Vepco counterclaimed for damage to its equipment allegedly caused by Savoy’s negligence.
