The plaintiff in error, hereinafter called defendant, was convicted in the district court of Carter county of manslaughter in the first degree, and his punishment fixed at confinement in the state penitentiary for a term of 25 years.

A brief summary of the facts disclosed by the record are about as follows: On April 18, 1925, defendant and his wife resided in the family of the wife’s father, Joe Pearson, at the town of Hewitt.
