NEVILLE, District Judge.

Defendant is accused in a one count indictment charging:

“That on or about the 5th day of August, 1969, at the City of Minneapolis, County of Hennepin, in the State and District of Minnesota, the defendant, Bruce Edward Murray, did knowingly and wilfully fail and neglect to perform a duty required of him under and in the execution of the Military Selective Service Act of 1967 and the rules, regulations, and directions duly made pursuant thereto, in that the defendant did fail and neglect to comply with an order of his local board to report for and submit to…
