The plaintiff’s evidence tends to prove that the plaintiff, with others, were creditors of the G. W. Pat terson Manufacturing Company, an insolvent corporation, and that tbeir debts were secured by deed in trust conveying real property to a trustee for tbeir benefit. Suit had been brought and a decree obtained foreclosing their lien, and the property was duly advertised for sale by the commissioner.
