The appellant, Henry Nichols, hereinafter called the plaintiff, sued the appellee, Union Stock Yards and Transit Company, hereinafter called the defendant, in the Superior Court of Cook county, in an action of assumpsit to recover damages for loss by fire, while in the possession of the defendant as a bailee thereof, of certain cattle belonging to the plaintiff.
